Terms and Conditions 089DJ Booking

1. Contracting parties

The following terms and conditions apply to the contractual relationships between 089DJBooking Munich - Robert James Perkins and its contractual partners (customers).

2. Contract

Contracts between 089DJBooking Munich and its customers are formed through

• Acceptance of a written offer (via email)
• written contract
• the spoken word (in person or by telephone)

3. Cancellation of the contract / booking

The customer may cancel at any time, however cancellation fees will be calculated as follows:

• Cancellation up to 30 days before the event: 25% of the agreed net fee
• Cancellation up to 20 days before the event: 50% of the agreed net fee
• Cancellation up to 10 days before the event: 100% of the agreed net fee

For basic offers, e.g., 5 hours + x, only the basic fee for, e.g., 5 hours is used to calculate cancellation costs; for all-inclusive offers, the fully agreed fee is used.

089DJBooking Munich may withdraw its consent through:

• technical failures
• Location conditions (noise restrictions)
• other important personal reasons
• Illness
• Accident
• Tod

In this case, 089DJBooking Munich will provide an equivalent replacement under the same conditions as previously agreed. Cancellation of the contract/booking must be made as early as possible, either by telephone or in writing.

4. Liability

The organizer is solely liable for personal injury and property damage during an event, unless the damage was caused by gross negligence or intentional conduct on the part of 089DJBooking Munich.
The organizer is liable for damage to equipment and music media belonging to 089DJBooking Munich caused during an event by guests or by third parties engaged by the organizer (external musicians, venue, photographers). The organizer is also liable for damage to DJ equipment caused by personal storage media (USB sticks, etc.) brought to the event (e.g., USB killers, viruses, Trojans, phishing tools).
Insofar as 089DJBooking Munich is unable to operate due to circumstances beyond its control and external influences such as:

• Force majeure
• natural disasters
• official order (volume limit, etc.)
• Operational disruptions at the event organizer
• Power outages or power fluctuations, etc.

If the agreed services cannot be provided, the customer has no right to withdraw from the contract, no claim for damages, and no right to withhold payment.

Damaged and/or non-functional equipment will be billed to the organizer/customer at the new price.

Parents are responsible for their children, and insults are not a trivial offense!

5. Payments

Payments must be made without deduction and exclusively to 089DJBooking Munich directly; the following payment methods are accepted:

• Cash payment before or immediately after the end of the event.
• By EC card/Maestro,  Pay, VISA card and MasterCard, before/during/immediately after the end of the event.
• Payment in advance to an account specified by 089DJBooking Munich, immediately after receipt of invoice.
• Payment is due immediately after the event, via bank transfer to an account specified by 089DJBooking Munich, upon receipt of the invoice. (For companies, agencies, and businesses only)
• (Euro)cheques or similar are not accepted.

6. Special Features

The DJ is free to design his music program and may refuse unsuitable music requests. The musical framework is always discussed with the client/organizer before the event begins.

Themed evenings or events focusing on a single music genre must be communicated in the initial offer; subsequent changes, including those made by the organizer on the night of the event, are not possible. In such cases, the artist/DJ reserves the right to cancel the performance without giving a reason. A penalty equal to the agreed-upon fee will be charged to the organizer/client.

All-inclusive offers include a maximum of 12 hours of pure music playing time, excluding setup/teardown and travel.

Special music tracks (music requests from the organizer, music for show elements, etc.) to be performed/played on the evening of the event must be provided by the organizer to the DJ as MP3 files via email or a cloud-based service (WeTransfer, Dropbox, Google Drive, OneDrive, SugarSync, etc.) the evening before the event, in a minimum quality of 128 kbps, unless they are already in the DJ's music library. USB sticks will only be accepted in exceptional circumstances.

Furthermore, no music tracks from streaming services such as YouTube, Spotify,  Music, Deezer, etc. will be played during the event, as 089DJ Booking Munich cannot guarantee an uninterrupted internet connection at the venue.

Additional services that cannot be provided at the venue (editing music tracks, producing FirstDances, etc.) will be billed separately and on an hourly basis.

Changes to the setup/location (lighting and sound system) during the event will be charged separately, depending on the effort involved, but at least €150!

The DJ's equipment will be dismantled at the end of the event. Setup and dismantling on the day before and after the event will be billed separately.

The DJ must be provided with a protected 220V AC power connection at the venue. Damage to the DJ's technical equipment caused by incorrect voltage or improperly installed and protected wiring will be billed to the connection owner.

For open-air events, the organizer must provide suitable sun and rain protection. The organizer/client is liable for any damage to equipment resulting from inadequate protection.

If the sound and lighting equipment is provided by the organizer or venue, the DJ assumes no liability whatsoever for its quality and/or functionality. Furthermore, the artist/DJ reserves the right to cancel the performance if the on-site equipment malfunctions or only partially functions, preventing the artist/DJ from delivering their usual performance. In this case, a penalty equal to the agreed-upon fee will be charged to the organizer/client.

Live artists (bands, cabaret performers, singers, instrumentalists, or similar) who wish to/need to connect to the DJ's sound system will be charged a separate rental fee. This type of equipment use is not automatically included in the offer.

Artists, DJs, bands and musicians recommended by 089DJ Booking Munich work on their own tax invoice and are independently responsible for all tax and insurance matters at an event.

Photos and videos taken by the DJ may be used without restriction for promotional purposes on his website and social media channels. Furthermore, the DJ reserves the right to decide at which events photos and videos are taken and whether they are used for promotional purposes. Should the client not wish for the publication and use of such material, this must be explicitly prohibited by the client/customer, either in writing or verbally, before the event begins.

For film and photographic material created by the organizer, hired photographers, or other service providers, and in which the artist is recognizable, the artist's written permission must be obtained before public use and distribution, including for advertising purposes, etc. (Right to one's own image)

7. GEMA fees and KSK

All applicable fees for the respective collecting society (e.g., GEMA, GVL, AKM, etc.) are borne by the event organizer and paid directly to the respective collecting society (e.g., GEMA, GVL, AKM, etc.). Contributions to the German Social Security Fund for Artists (KSK) are to be borne by the client/event organizer.

The place of jurisdiction is Munich.
